With the fall of the ruble exchange rate, the economic situation in the country worsened. Many families who took advantage of mortgage programs began to experience difficulties in repaying their debt. To help borrowers, the Government signed a Decree regulating the scheme and methods for implementing loan restructuring. Read the article for details about the mortgage borrower assistance program.


Who will the government help pay off their mortgage debt?

The government is ready to help borrowers who are citizens of the Russian Federation subject to certain conditions:

  • the client documents a decrease in family income of more than 30%;
  • the income per family man after taking into account the mortgage contribution is less than one and a half subsistence minimums;
  • there is no information that the person has been declared bankrupt in court.
  • the family is a participant in a federal or municipal program to optimize housing conditions and has taken out a preferential mortgage;
  • there are one or more minor children in the family;
  • the borrower is a combat veteran, disabled or has a disabled child;
  • the client is a government employee with at least 1 year of experience.

Options for government support for borrowers

There are several alternative options for helping insolvent debtors.

  1. The loan currency is converted into national currency at the current exchange rate.
  2. The rate on a foreign currency loan is set no higher than 12% per annum. The rate on a ruble loan is fixed until the end of the lending period.
  3. The current payment is reduced to 50% for up to one and a half years. In this case, the underpaid amount is carried forward to subsequent periods.
  4. The client’s financial obligations are reduced by 10% of the debt balance, but not more than RUB 600,000.
  5. The bank does not charge the client any fees for restructuring.

The choice of restructuring option depends on the specific terms of the agreement: the currency of the loan, its validity period, etc. The lender is not obliged to write off fines and penalties accrued to the client for late payment, but may do so at his own discretion.

Government Resolution 373

On April 20, 2015, Government Resolution No. 373 became valid. According to this document, certain categories of borrowers received the right to loans in national or foreign currency. This includes the following cases:

  • family income decreased by more than 30%;
  • Due to the depreciation of the ruble, loan payments in foreign currency increased by more than 30%.

Restructuring in this case involves the following adjustments to the terms of the contract:

  • reduction of the current contribution for a period of no more than 1 year;
  • partial write-off of the debt body;
  • change in the loan rate – no higher than 12% per year.

When restructuring mortgage loans, creditor banks have the opportunity to return part of the lost profit within 6-12 months. For one loan, the permissible repayment limit is 10% of the loan balance, but not more than 600 thousand rubles.

In addition, the authorized capital of OJSC AHML was additionally financed by 4.5 billion rubles. This means that even more families will be able to count on assistance from the state.

Where to contact

To take advantage of the program, the borrower must contact his lender with a corresponding application. The website of the Mortgage Lending Agency shows that they have entered into a cooperation agreement with AHML.

Assistance program from AHML

AHML is only the regulator of the assistance program; this organization does not make decisions on mortgage restructuring. If the creditor agrees to this procedure, AHML will compensate the financial institution for losses based on the corresponding application.

Conditions for assistance to mortgage borrowers

At the time of filing an application for restructuring, the loan agreement must be valid for at least 1 year. The security can be a pledge of housing put into operation or a pledge of rights of claim under an agreement for participation in shared construction. The main requirements for the collateral object are:

  • the property is located in Russia;
  • the total area of ​​the property is no more than 45, 65 or 85 square meters. m for a one-room, two-room and three-room house/apartment;
  • cost of 1 sq. m of real estate does not exceed by more than 60% the cost of standard housing at the time of signing the initial transaction.

If there are three or more children in the family, the last point may not be observed. The premises in which the borrower's family lives must be the only one. The borrower or his family members are allowed to have a share in the ownership of other real estate, but not more than 50% in each premises.

Documents for registration

To take advantage of the restructuring program, the borrower must submit a corresponding request to the bank. Attached to this document:

  1. Photocopies of the passport of the borrower, mortgagor, and members of their families. For children - birth certificate.
  2. Marriage/divorce certificate.
  3. Confirmation of income: salary certificate and copy of the work book, certificate from the pension fund, certificate of state. entrepreneur registration and tax returns, certificate from the employment center, etc.
  4. Loan documents:
  • loan agreement;
  • mortgage payment schedule at the time of receiving the loan and at the time of filing an application for restructuring;
  • extract from the Unified State Register of Real Estate Rights;
  • agreement for participation in shared construction;
  • assessment of collateral at the time of loan receipt.

One of the methods of helping the population is to reduce the size of the debtor’s obligations. This can happen through:

  • converting the loan currency into rubles;
  • interest rate reduction;
  • one-time forgiveness of part of the debt.

When using the third mechanism, the state compensates the creditor for losses, i.e. lost profit.

Today, according to the latest amendments to 373 Government Resolution dated November 24, 2016, assistance to mortgage borrowers (mortgage restructuring) valid until March 1, 2017(extended until May 31, 2017 by Decree of the Government of the Russian Federation dated 02/10/2017 No. 172, from 03/07/2017 the acceptance of new applications has been suspended due to the expenditure of funds under the program.

However, in July 2017, an additional 2 billion rubles were allocated from the government fund to resume the program.   • Before September 1, a special interdepartmental commission must be created that will be able to increase the maximum payment under the program by 2 times and approve applications for participation if there are deviations from the basic conditions, but not more than in two points.

There is an opinion that very often banks refuse to carry out mortgage restructuring, but in fact this procedure is very beneficial for them because losses incurred by the bank (lost interest income) due to early repayment are compensated by the state.

Changes to the mortgage assistance program dated 02/10/2017 suggest that the maximum compensation of 30% of the balance (up to 1.5 million rubles) is compensated by the state only if there are two children in the family or you are disabled (disabled child), and military veterans can also apply actions. With one child you can only claim 20%. Changes dated August 10, 2017 allow the maximum payment to be doubled by decision of a special interdepartmental commission.

Having analyzed the negative reviews about mortgage repayment with the help of the state, our experts came to the conclusion that most often the basis for refusal is inaccurate information provided by the borrower and lack of knowledge of the basic requirements and conditions of state support. Who can receive support from the state

Government Decree No. 373, as amended on November 24, 2016, provides the following list of persons to whom the state can help pay mortgage payments:

  • Citizens of the Russian Federation with 1 or more minor children;
  • Guardians (trustees) of 1 or more minor children;
  • Participants in hostilities;
  • Disabled people or families with disabled children;
  • Citizens with dependent children under 24 years of age who are studying full-time at an educational institution.

Requirements for mortgage housing

To receive assistance from the state, the mortgaged apartment must meet these characteristics:

  • Should not exceed the total area for a one-room apartment - 45 sq.m., for an apartment with two rooms - 65 sq.m. and for three rubles or more - 85 sq.m.
  • Cost of 1 sq.m. the total area of ​​housing exceeds no more than 60% of the average cost of a typical apartment in your region on the date of conclusion of the loan agreement (according to the Federal State Statistics Service).
  • The residential premises must be the only one for the mortgage borrower. Requirements for mortgage borrowers

  • Russian citizenship

One extract on property rights throughout Russia is 1,500 rubles per person and no one will return it to you if you refuse. Last time there were a lot of complaints about this. As of August 11, 2017, the requirement to have an extract from the Unified State Register has been cancelled. The bank has no right to demand it. AHML independently requests it.

After a complete list of documents is provided to the bank, the responsible employee must send them to AHML for verification. On average, it lasts 30 days, but feedback from participants indicates that it can last up to six months. The bank and AHML request additional documents at their discretion.

When AHML makes a positive decision, the bank will notify you of the date of the meeting. Next, you will need to sign a new payment schedule, a new PSK document, enter into a restructuring agreement (additional agreement to the mortgage agreement), and an agreement to change the terms of the mortgage. Next, you will need to wait from 2 to 4 weeks, when the mortgage will be requested from the bank’s archives. After this, it is necessary, together with a complete package of loan documents and an agreement to change the terms of the mortgage (be sure to make copies), to visit the justice system for state registration of changes.

The process is similar at Gazprombank. VTB 24 closes your mortgage and issues a new loan for a smaller amount, which means that you again have to pay for insurance and appraisal.

There is no charge for mortgage restructuring. Carrying out this procedure does not relieve you from paying the monthly payment and insurance premiums stipulated by the contract.

Reimbursement under the program is carried out for residential mortgage loans (loans), restructuring agreements for which were concluded before May 31, 2017.

Conditions for providing support to mortgage borrowers (as amended before August 2017)

Citizens can count on help with mortgage difficulties if 6 conditions are met simultaneously(listed below):

1 mandatory condition - categories of borrowers. The main requirement is that assistance is provided only to citizens who have minor children, or are combat veterans, or are disabled (or have disabled children).

Condition 2 - a decrease in the borrower's income.

To receive assistance, it is necessary that one of the consequences specified in clause 2.1 and one of the consequences specified in clause 2.2 occur (simultaneously).

2.1. The average monthly income of the borrower (joint and several debtors), calculated for the 3 months preceding the date of filing the restructuring application, must decrease by at least 30% compared to the average monthly income of the borrower (joint and several debtors), calculated for the 3 months preceding the date of conclusion of the loan agreement ( loan agreement), or the amount of the planned monthly payment on the loan (loan), calculated on the date of filing the application for restructuring (in ruble equivalent at the rate of the relevant currency established by the Central Bank of the Russian Federation on the same date), must increase by at least 30% according to compared to the size of the planned monthly payment calculated on the date of conclusion of the loan agreement (this paragraph does not apply since 2017 due to the publication of Decree of the Government of the Russian Federation dated November 24, 2016 N 1231);

Condition 4 – requirements for room area.
