But the deadline for handing over the keys is the period specified in the share participation agreement. And the developer HAS NO RIGHT to unilaterally adjust this period. For violation of this deadline, according to the current legislation (214 Federal Law), the developer is obliged to pay a penalty to each shareholder in the amount of 1/150 of the refinancing rate for each day of delay. What happens after receiving the certificate of putting the house into operation? The finishing of the apartments and landscaping (flower beds, lawns, etc.) are being completed. Commissioning work is carried out: we start and set up the operation of elevators, give operating pressure to the pipes, check the operation of pumps, leak control systems, meters, etc., blow out smoke removal fans, etc. We conclude basic service agreements with energy suppliers (Heating Network, Vodokanal, Lenenergo, etc.). The developer's customer service department accepts all apartments from the general contractor and checks the quality of the finishing. In case of complaints, he issues an order for elimination. The notification is sent to the shareholder by registered mail with a list of attachments and a return receipt to the address specified in the agreement for sending postal correspondence, or delivered to the shareholder personally against signature. All this usually takes about 4 months.

Design

For some reason, the developer is positioning them as two houses, the first of which has one section, and the second has three. The technology of their construction is somewhat unusual. Here two floors of each building were removed, monolithic columns were poured from reinforced concrete, and already higher they began to make monolithic floors and load-bearing walls. According to the developer's plan, the external walls were to be made of brick; the DDU (appendix) indicated that they would be made of aerated concrete. As a result, they became foam concrete. The facade was planned to be insulated with fiber cement boards. Photos of Birch Grove shareholders posted on the forum show that in some places the builders used split foam blocks, which resulted in curvature of the structures, and large installation gaps were visible along the windows. Now all this is no longer visible, since the finishing of the facades has been laid on top.

The construction permit was received by the Polis Group company on August 1, 2013. At the same time, the official sale of apartments began with the preliminary signing of the DDU. Some shareholders noted in their reviews that the sales managers suggested that they sign the PDDU (preliminary agreement) before the go-ahead to start construction was received, that is, back in July. People reported a 10% fine, which must be paid by the shareholder who did not complete the DDU on time after signing the DDU. Whether this is true or not can no longer be verified, but such reviews left potential buyers with an unpleasant aftertaste. Further events developed without problems. The work of the “Polis Group” was going well, so the delivery of all buildings was scheduled in one phase for the third quarter of 2015.

"Birch Grove" (Kudrovo): deadline

Seeing the buildings growing high on the construction site, the shareholders were already packing their suitcases, preparing to move. But suddenly unexpected difficulties began. First, it turned out that the soil at the site of the Birch Grove construction had a complex geological structure. Their development required additional costs and volumes of work. Then problems arose with the Zanevka company, which is engaged in laying communications to the residential complex in the village of Kudrovo, and the Berezovaya Roshcha residential complex, among others. The aforementioned “Zanevka” did not share something with the “Stroy Polis” company, the conflict turned into legal proceedings. These circumstances slowed down the progress of construction of the Berezovaya Roshcha residential complex (Kudrovo) and forced Polis Group to postpone the commissioning of the facility to 2016. Now the buildings were surrendered one by one:

  • in the first quarter - one house;
  • in the second quarter - two houses;
  • in the third quarter there is also one house.

By the end of last year, the company again failed to deliver anything and again postponed the deadline, now to the first quarter of 2017, but once again they installed one queue.

"Birch Grove" (Kudrovo): why don't they rent it out?

This question interests every shareholder. According to representatives of Polis Group, the acceptance committee was supposed to start work in September. Then it was postponed to December, and investors were promised the keys to the New Year. As the general contractor explained, there was still a commission, but it did not accept the complex, revealing several dozen violations. Now workers are removing them as planned. None of those who bought housing in Birch Grove know how serious these violations are. People see that practically nothing has yet been done regarding the declared landscaping of the territory, that many apartments do not have proper finishing, but there are installation gaps that have not been fixed, unglazed balconies, and incompletely finished facades. Most shareholders hope to receive the keys by March. But the fact that the construction of the Birch Grove is permitted until August 2017 is alarming.
